Marlboro Township Planning Board to Consider Creation of 15 New Residential Lots

PLEASE TAKE NOTICE that the Applicant, Adam Buchman (Gina Hill Farm), has applied to the Planning Board of the Township of Marlboro for preliminary major subdivision approval to consolidate and subdivide the existing three (3) lots containing a total of 85.5 acres known and designated as Block 157, Lots 21.01, 21.02, and 21.03 on the tax map of the Township of Marlboro into two (2) new lots; proposed lot 21.04 to be 5.0 acres and proposed lot 21.05 to be 80.5 acres, located on Newman Springs Road with frontage also on Igoe Road located in a LC zone.

River Vale to Consider Environmental Trade Offs in 8 Lot Subdivision

PUBLIC NOTICE  “PLEASE TAKE NOTICE that the undersigned attorneys for Bear-Ban Builders, LLC (hereinafter the “Applicant”), with the consent of the record owner, Henry J. Bonnabel, for property fronting along Rivervale Road between John Shine Court and Tiffany Avenue and more formally known as Block 2103, Lot 10 on the current Tax Assessment Map of the Township of River Vale, New Jersey (hereinafter the “Property”) has filed an application. The Property is currently vacant and the Applicant received approval for its prior application to subdivide the Property for the construction of single family homes. The Property is located in the “B” Residential District of the Township of River Vale, New Jersey. PLEASE TAKE FURTHER NOTICE that the Applicant previously applied for, and received, Preliminary and Final Major Subdivision Approval, Soil Moving Permit and Tree Removal Permit (hereinafter “Prior Approvals”). The Prior Approvals were memorialized by a resolution adopted by the Township of River Vale Planning Board on June 20, 2011. The Prior Approvals permitted the Applicant to remove 262 trees and to provide 330 new replacement trees. The Prior Approvals also authorized the soil moving necessary for the subdivision and permits the Applicant to effectuate the cut of 2145 c.y., fill of 1674 c.y. with a net export of 471 c.y. from the site. The Prior Approvals authorized the subdivision of the Property into 8 conforming lots, each of which have frontage and driveway access along Rivervale Road. The Prior Approvals contained a condition requiring the Applicant to make significant roadway improvements to the east side of Rivervale Road and to re-profile that road to address existing conditions that the Township believed needed immediate attention. The Prior Approvals also contemplated that the additional drainage resulting from the widening of Rivervale Road along its westerly side as it abuts the Property would necessitate additional drainage to be connected into the municipal pipes on John Shine Court.  PLEASE TAKE FURTHER NOTICE that the Applicant is requesting, in accordance with Condition XII on Page 13 of the resolution granting the Prior Approvals by the Township of River Vale Planning Board, by this formal application to the Township of River Vale Planning Board that the conditions requiring improvements to the east side of Rivervale Road be removed from the terms and conditions of the Prior Approvals granted to the Applicant. In connection with this request, the Applicant specifically requests an Amended Tree Removal Permit to permit the removal of 268 trees and to provide 334 replacement trees in accordance with the landscape plan previously approved by the Board. Further, since the connection to the municipally owned pipes to John Shine Court has not been secured, the Applicant requests an Amended Preliminary and Final Subdivision Approval to permit the discharge of the road water from the additional pavement on the west side of Rivervale Road to the wetlands to the rear of the proposed homes. The proposed discharge of the waters into the wetlands has been approved by the New Jersey Department of Environmental Department by permit. Further, since Rivervale Road is under the jurisdiction of the County of Bergen, an application has been made to the Bergen County Planning Board and conditional approval granted to eliminate the widening requirements of the west side of Rivervale Road and the redirection of the drainage to the wetlands. The Bergen County Planning Board granted conditional approval of the Applicant’s application by conditional approval dated June 10, 2013.  PLEASE TAKE FURTHER NOTICE that the application, as proposed to be amended, remains fully compliant with the Township of River Vale Ordinances. However, the Applicant will also request any and all other variances, exceptions, waivers, de minimis exceptions, interpretations and/or incidental relief from the requirements of the Township of River Vale Ordinance that may be required by the Board after a review of the application. PLEASE TAKE NOTICE that the Township of Ocean Planning Board (the “Board”) will conduct a public hearing on Thursday, December 5, 2013 at 7:00 P.M. in the Township of Ocean Town Hall at 50 Railroad Avenue, Waretown, New Jersey, County of Ocean.
The Application is made by MBI Development Company, Inc. (the “Applicant”) concerning the property identified as Block 41, Lots 25, 26, 27, 28, 29.03, 29.07, 30, and 36.01 on the Tax Map of the Township of Ocean.
The Applicant seeks to construct a three story 76 Unit Residential Structure for age restricted (senior) affordable rental housing.

Right-of-way: Willow Street meets the 60′ right-of-way requirement, however, Willow Street will be a private street and not a municipal street;
Memorial Drive sidewalk (both sides): The Township Zoning Ordinance requires a 10′ wide sidewalk on both sides of a street. Applicant proposes a 4′ sidewalk on one side, as the Applicant does not have ownership or control of the other side of Memorial Drive;
Willow Street sidewalk (both sides): The Township Zoning Ordinance requires a 10′ wide sidewalk on both sides of a street. Applicant proposes a 86′ sidewalk on one side. The Applicant has safety concerns about sidewalks on both sides of the privately owned Willow Street;
Parking requirements on both sides of Memorial Drive: The Township Ordinance requires 9′ wide parking spaces on both sides of a street. As previously indicated, the Applicant does not own or control the other side of Memorial Drive. In addition, the Applicant proposes no parking on Memorial Drive as there is sufficient parking within the development;
Parking requirements on both sides of Willow Street: The Township Ordinance requires 9′ wide parking facilities on both sides of a street. The Applicant proposes 20 angled parking spaces on one side of Willow Street; and
-Any and all other waivers, variances, or approvals that the Board may require.

PLEASE TAKE NOTICE that on Tuesday, November 12, 2013, the Township of North Brunswick Planning Board adopted a resolution (“Resolution”) memorializing its October 24, 2013 approval of the application of North Brunswick TOD Associates, LLC for amended preliminary and final major subdivision approval for Lots 9, 10 and 141.02 in Block 141, and for final major site plan approval for Phase 1B (Building H-3) of a Transit-Oriented Mixed Use Development, to be developed on the property located at 2300 U.S. Route 1 North, North Brunswick, New Jersey 08902, and also known and designated as Block 141 (new), Lots (new) 1 through 7, 11 through 24, 29, 31, 33, 33.02, 36 through 48.01, 49 through 60, 63, 120 through 123 and 141 through 142 on the current tax and assessment map of the Township of North Brunswick (“Property”). TAKE NOTICE THAT the Planning Board of the Town of Morristown, New Jersey, will hold a hearing on December 5, 2013, at 7:30 p.m. in the Council Room, Morristown Town Hall, 200 South Street, Morristown, New Jersey, to consider an application affecting the property whose street address is known as 185 Morris Street, Morristown, New Jersey and designated as Block 3701, Lot 11 on the Morristown Tax Map and the contiguous property known as 10 Ford Avenue, Morristown, New Jersey, Block 3701, Lot 10 on the Morristown Tax Map.
The conditions affecting this property and the reasons for the application being heard are as follows:
The Applicant, Leona Developers, LLC (“Leona”), (Owner is Peter Cipollini), of 185 Morris Street, Block 3701, Lot 11, was designated by the Morristown Council as the redeveloper of its property by the Morristown Council Resolution No. 32-12 (2/10/12) and extended by various Resolutions (R-77 (3/14/13) and R-168 (9/12/13)). The contiguous property Owner Mountain Center Realty, LLC (“Mountain”), 10 Ford Avenue, Block 3701, Lot 10, was designated by the Morristown Council as the redeveloper of its property by the Morristown Council Resolution No. 32-13 (2/10/12) and extended by various Resolutions (R-78 (3/14/13) and R-169 (9/12/13)). Both property owners (Leona and Mountain) seek approval of development projects pursuant to the Morristown Council’s redevelopment plan (pursuant to New Jersey Local Redevelopment & Housing Law (“LRHL”) – N.J.S.A. 40:12A-1 et seq. and the foregoing Resolutions) for the properties. Leona seeks preliminary and final site plan approval and minor subdivision approval to construct 37 units of Condominiums/Apartments/Townhomes pursuant to the Morristown Council’s redevelopment plan. Leona’s construction will take place in the RT-1 Zone and seeks approval for 75% impervious coverage, where only 40% impervious coverage is permitted in the RT-1 Zone. Leona and Mountain have entered into an Agreement to jointly construct certain infrastructure improvements and have the appropriate easements in place to facilitate same.
Applicant requests any other waivers or variances or such other relief as may be required by the Board or its professionals at the time of the hearing.
The application forms and supporting documents are on file in the Planning/Zoning offices at the Morristown Town Hall, 200 South Street, Morristown, New Jersey, and may be inspected during operating hours, Monday through Friday. Any interested party may appear at the hearing and participate therein, subject to the rules of the Board.

PLEASE TAKE NOTICE that the Applicant, CCP&Q. Inc., has applied to the planning Board of the Township of Hamilton for preliminary major subdivision approval on property located on Harding Highway and Millville Avenue, and known all Lot 2.01 in Block 670 on the official Tax Map of Hamilton Township, Atlantic County, New Jersey for the purpose of subdividing the property into nine (9) single – family residential lots.
