Maurice River Land Use Board to Investigate Potential Redevelopment Location

PUBLIC NOTICE MAURICE RIVER TOWNSHIP LAND USE BOARD NOTICE OF PUBLIC HEARING Please take notice that the Land Use Board of the Township of Maurice River will hold a Public Hearing on November 5, 2014 at 7:00 p.m. at the Municipal Building, 590 Main Street, Leesburg, NJ. The public hearing is part of the preliminary investigation by the Land Use Board as to whether Block 278, Lots 77, 77.01, 77.02, 78, 79, 80 & 81; Block 279, Lots 1, 2, 3 & 4; Block 280, Lots, 1, 2, 3, 4, 4.01 & 4.02; Block 281, Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 12.01, 13, 14, 15, 15.01, 16, 17, 18, 18.01 & 19; Block 282, Lots 1, 2 & 3; and Block 296, Lots 33, 34 & 35 as shown on the Municipal Tax Map is an area in need of redevelopment under N.J.S.A. 40A:12A-5. Upon completion of its investigation, the Land Use Board will provide its recommendation to the Township Committee. Those redevelopment areas where the municipality declares it will not use eminent domain are referred to as “Non-Condemnation Redevelopment Areas.” Resolution 85-2014 declared that the entire area to be the focus of the study would be designated as a “Non-Condemnation Redevelopment Area.” If the Township Committee adopts a Resolution determining that the property or properties are in an area in need of redevelopment, such designation shall constitute a finding of public purpose which will authorize the Township to offer tax or other financial incentives to encourage the appropriate redevelopment of the area. The study area is located in the Leesburg Riverfront Area. The Preliminary Investigation, Determination of an Area in Need of Redevelopment Report as well as maps showing the extent of this area are on file in the Land Use Board office of the Township of Maurice River Municipal Building and are available for inspection Monday through Friday from 8:30 a.m.-3:00 p.m. Anyone who is interested in, or who would be affected by a determination that the area is in need of redevelopment as defined in N.J.S.A. 40A:12A-5 and who favor or are against such a determination may be heard at the above stated time and place. Emerson Borough Authorizes The Acquisition of Easements to Improvement Redevelopment Area

BOROUGH OF EMERSON COUNTY OF BERGEN, NJ  NOTICE OF INTRODUCTION  Introduced: June 17, 2014 NOTICE IS HEREBY GIVEN that the following proposed Ordinance was introduced and passed on first reading at the Regular meeting of the Borough Council of the Borough of Emerson on the 17th day of June 2014, and that said proposed Ordinance will be further considered for final passage at the meeting of said Borough Council to be held on the 1st day of July 2014 at 7:30 p.m., or as soon thereafter as said matter can be heard at the Municipal Building, Linwood Avenue, Emerson, New Jersey, at which time and place all persons who may be interested therein shall be given an opportunity to be heard concerning same. ORDINANCE 1487-14  AN ORDINANCE OF THE BOROUGH OF EMERSON, IN THE COUNTY OF BERGEN, NEW JERSEY AUTHORIZING THE ACQUISITION OF EASEMENTS OVER AND THROUGH VARIOUS BLOCKS AND LOTS ON THE OFFICIAL TAX MAP OF THE BOROUGH OF EMERSON LOCATED ALONG KINDERKAMACK ROAD FOR ROADWAY IMPROVEMENTS. WHEREAS, pursuant to N.J.S.A. 40:48-2, the Borough of Emerson (“Borough”) is authorized to adopt an Ordinance for the preservation of public health, safety and welfare; and WHEREAS, pursuant to N.J.S.A. 40A:12-5, the Borough of Emerson has the power to acquire any real property for a public purpose through negotiated agreement or by the exercise of its powers of eminent domain. WHEREAS, the County of Bergen is undertaking Roadway Improvements to Kinderkamack Road (the “Project”) which requires the Borough to acquire the necessary interests in the properties affected by the roadway improvements; and  WHEREAS, the Project requires various off-tract roadway improvements to be constructed which will improve traffic flow within the Project and within the Borough (the “Improvements”); and  WHEREAS, the Borough of Emerson has previously adopted Ordinances number 135-06 and 1394-10 implementing and reaffirming the 2006 CBD Redevelopment Plan which contemplated and authorized improvements to Kinderkamack Road; and  WHEREAS, in order to undertake such Improvements, it is necessary that the Borough acquire easements on, over and through various Blocks and Lots on the Official Tax Map of the Borough of Emerson, Bergen County, New Jersey, located along Kinderkamack Road (the “Easements”) as follows: Block 201, Lot 1 Block 412, Lot 3 Block 419, Lot 4 Block 419, Lot 6.01 Block 419, Lot 6.02 Block 419, Lot 9 Block 419, Lot 9 Block 419, Lot 9 Block 419, Lot 8 Block 419, Lot 8 Block 420, Lot 2 Block 420, Lot 16 Block 420, Lot 16 Block 422, Lot 1 Block 422, Lot 13 Block 422, Lot 14-15 Block 422, Lot 16 Block 422, Lot 17 Block 422, Lot 18 Block 422, Lot 18 Block 606, Lot 4 Block 610, Lot 1 Block 610, Lot 1 Block 610, Lot 2 Block 615, Lot 1 Block 616, Lot 1 Block 616, Lot 1 Block 412, Lot 4 Block 412, Lot 5 Block 419, Lot 5 Block 422, Lot 9 Block 616, Lot 2 and Block 616, Lot 3 WHEREAS, the Borough Council of the Borough of Emerson has determined that the contemplated Improvements would improve the traffic flow throughout the Borough, and would serve a public purpose and be to the benefit of the health, welfare and safety of the Borough’s citizens for the Borough to acquire the Property(s) and/or any interests therein.   NOW, THEREFORE BE IT ORDAINED, by the Borough Council of the Borough of Emerson, County of Bergen and State of New Jersey being the governing body thereof that: 1. The Mayor and Borough Clerk are hereby authorized to execute and witness any documents or instruments necessary to acquire the Easements and/or any property interests to the properties.   BE IT FURTHER ORDAINED, that if any section, paragraph, subsection, clause or provision of this Ordinance shall be adjudged by the courts to be invalid, such adjudication shall apply only to the section paragraph, subsection, clause or provision so adjudicated, and the remainder of the Ordinance shall be deemed valid and effective; and  BE IT FURTHER ORDAINED, that any ordinances or parts thereof in conflict with the provisions of this Ordinance are repealed to the extent of such conflict; and  BE IT FURTHER ORDAINED, that this Ordinance shall take effect upon passage and publication in accordance with applicable law. Evesham to Acquire Property for Redevelopment

NOTICE TOWNSHIP OF EVESHAM ORDINANCE 9-4-2014 AN ORDINANCE AUTHORIZING ACQUISITION OF PROPERTIES LOCATED WITHIN TOWNSHIP REDEVELOPMENT AREA WHEREAS , by Resolution 190-2013, the Township Council of the Township of Evesham declared certain properties in the Route 70/Route 73 corridor to be ‘areas in need of redevelopment’ within the meaning and intendment of the New Jersey Housing and Redevelopment Law, N.J.S.A .40A:12A-1 et seq.; and WHEREAS ,by Ordinance 28-11-2103, the Township Council adopted a Redevelopment Plan for certain properties known as Block 3, Lot 3, and Block 27.02, Lot 2, properties familiarly known as ‘G Boys’, and ‘Tri-Towne Shopping Center’ respectively; and WHEREAS , the Redevelopment Plan identified both of said properties as properties for which redevelopment acquisition might be necessary in order to fulfill the goals and purposes of the Redevelopment Plan; and WHEREAS , the Township Council has authorized and commissioned certain appraisals for said properties to establish the fair market value of same in the event it determines to move forward with redevelopment acquisition of said properties; and WHEREAS , said appraisals are expected to be received in the next few weeks, and the governing body, while continuing to pursue various means by which said properties can be privately redeveloped, is, nevertheless, interested in ensuring that the continued passage of time does not result in unnecessary continued deterioration and dilapidation of said properties without municipal intervention; and WHEREAS , therefore, the governing body deems it appropriate to provide for the authorization of the acquisition of said properties, should same prove both financially feasible, and necessary to promote the Redevelopment Plan; and WHEREAS , although the Redevelopment Plan, adopted by Ordinance 28-11-2013 already authorizes said acquisition, the governing body has determined to also enact this Ordinance in accordance with the provisions of the New Jersey Local Lands and Buildings Law, N.J.S.A .40A:12-1 et seq. NOW, THEREFORE, BE IT ORDAINED AND ENACTED , by the Township Council of the Township of Evesham, County of Burlington, State of New Jersey as follows: Article I.Acquisition Authorized . The Township Council hereby authorizes, subject to receipt of appropriate appraisals, and the undertaking of good faith negotiations in accordance with the provisions of N.J.S.A .20:3-1 et seq., and particularly 20:3-6, the acquisition of the properties known as Block 27.02, Lot 2, and Block 3, Lot 3, within the Township of Evesham, pursuant to the Redevelopment Plan previously adopted under the Redevelopment and Housing Law, N.J.S.A .40A:12A-1 et seq. Article II.Effectuation of Authorization granted above . The Township Manager, Solicitor, Director of Community Development, and such other municipal officials as the Manager may deem necessary and appropriate, are hereby authorized and directed to take such actions, engage in such negotiations, secure such title searches and insurance policies, and to do any and all other things necessary to effectuate the acquisition of the properties identified in Article I above. Notwithstanding the foregoing, however, no Agreements of Sale, nor the incurrence of any debt, nor the institution of any litigation in furtherance of said acquisition, shall be permitted without further formal action of the Township Council, which may be authorized by motion or resolution. Article III.Repealer, Severability and Effective Date. A. Repealer . Any and all Ordinances inconsistent with the terms of this Ordinance are hereby repealed to the extent of any such inconsistencies. B. Severability . In the event that any clause, section, paragraph or sentence of this Ordinance is deemed to be invalid or unenforceable for any reason, then the Township Council hereby declares its intent that the balance of the Ordinance not affected by said invalidity shall remain in full force and effect to the extent that it allows the Township to meet the goals of the Ordinance. C. Effective Date . This Ordinance shall take effect upon proper passage in accordance with the law. Harrison Joint Land Use Board to Hold Preliminary Investigation for “Area in Need Study”

>  PUBLIC NOTICE    HARRISON TOWNSHIP   JOINT LAND USE BOARD NOTICE    PLEASE TAKE NOTICE that the Harrison Township Joint Land Use Board will hold a public hearing on March 20, 2014, at 7:30 P.M. in the Harrison Township Municipal Building Courtroom, 114 Bridgeton Pike, Mullica Hill, New Jersey.  The purpose of the public hearing is for the Harrison Township Joint Land Use Board to conduct a preliminary investigation, pursuant to N.J.S.A. 40A:12A-1, et seq.
